AGENT AGREEMENT AND TERMS OF SERVICE:
This Agent Agreement ("Agreement") is entered into between Nox Cape Town ("Nox"), a short-term rental management company based in Cape Town, South Africa, and the undersigned travel agency, tour operator, or broker ("Agent"). By participating in this Agreement, both Nox and the Agent agree to the terms and conditions outlined below, which is full and binding upon the receipt of a deposit payment towards an accommodation booking with Nox.
AGENT’S RESPONSIBILTIES:
- Use of Agent Centre and Terms of Service: Agent acknowledges and agrees to utilize Nox Cape Town's Agent Centre for accessing product information and reviewing the Terms of Service, as provided at the following link: **https://www.notion.so/noxcapetown/Agents-Centre-cc165ce1e1914a8aac7f82eb0e84c33d**.
- Guest Occupancy and Rental Policies: Agent acknowledges and agrees that all guest occupancy of accommodations managed by Nox is subject to the rental policies, terms, and conditions detailed here: **https://www.noxrentals.com/terms-and-conditions**.
- Reservation Policies and Workflow: Agent agrees to adhere to the following reservation policies and workflow:
- Nox will hold availability for a period of 72 hours.
- Once we receive your written confirmation, the reservation is placed into an Awaiting Payment status for another 72hours.
- Nox reserves the right to release any held accommodation if pre-payment does not reach Nox within the specified period.
- Guest contact details (Name, email and cell number) are required before or on confirmation
- Agent further acknowledges that Nox reserves the right to request payment directly from guests upon arrival if payment has not been received before the specified dates.
- Agent must notify Nox if they wish to extend the hold beyond the initial 48-hour period.
- The duration of hold availability may be adjusted based on a case-by-case assessment and seasonal variations.
- Deposit Payment: Agent acknowledges and agrees to the deposit payment terms:
- A 50% deposit is required to secure the availability of accommodations.
- An additional 50% deposit must be paid no later than 30 days before the scheduled arrival date.
- Payment of the deposit signifies Agent's acceptance of the rental and cancellation policies.
- Guest Screening and Deposit Process: Agent acknowledges and agrees that all guests will undergo a pre-arrival and damage deposit process, as described in detail here: **https://www.notion.so/noxcapetown/Nox-Damage-deposit-process-a025848558794ca796dda08023ba6620**.
- Security Deposit Option: Agent may opt to pay Nox a security deposit of R20,000, which will be held in a money-market linked investment account. This deposit may be drawn upon by Nox to cover incidental damages for all reservations.
- If damage is deducted from the deposit, Nox reserves the right to not check in the next set of guests if the full amount of R20,000 isn’t topped up.
- In the event that damage exceed R20,000, the Agent also agrees to recover total costs or to pay total costs.
- Product Information Accuracy: Agent acknowledges that they are responsible for referencing Nox's Nitro quoting system for up-to-date product information. Agent understands that accurate presentation of amenities and property characteristics to clients is their responsibility, and Nox will not be held liable for any false advertising.
